Pertaining to completeness of various proposing procedure, and proposal contents in compliance with powers and functions of Legislative Yuan.
Pertaining to merger, classification and order changing of proposals.
Pertaining to allocating discussion time of government proposal and Legislator proposal.
Pertaining to time allocation of political parties interpellation and Legislator's individual interpellation.
Pertaining to dealing with problems related to agenda which are submitted by conference of Legislative Yuan.
Pertaining to outward deliberation, handing over, replying and notice of petition by the public.
The Organic Rules for the Procedure Committee of the Legislative Yuan
(Articles 2, 3, 5 and 9 were amended on 30 November 2007. Article 5 was amended at the 16th Meeting, Session 2, the 7th Legislature, on 6 January 2009.)
Article 1 These rules are established according to Article 7 in the Organic Act of Legislative Yuan.
Article 2 The Procedure Committee (PC) shall be formed with 19 members selected from each political party according to the proportion of seats in the legislature. However, at least one member shall be selected from each party.
Article 3 Two conveners shall be elected from the members of the PC. These conveners shall chair, in turns, the committee meeting.
Article 4 The functions and duties of the PC shall include:
(1) To review if motions are made according to the relevant procedure and their contents correspond to the authority of Legislative Yuan.
(2) To merge, to classify bills and to change their order.
(3) To distribute time for discussing motions made by the government and legislators.
(4) To distribute time for party and individual interpellations.
(5) To settle issues concerning conference procedures referred to by the Yuan sitting.
(6) To review, refer, reply and notify petitions made by citizens, including format review.
Regardless of without the title of petitions, any document
meets the requirements specified in Article 5 of the Petition
Act shall be considered as petitions.
Petitions made to the government agencies but with a duplicate delivered to Legislative Yuan shall be referred to the relevant committee(s) for reference.
Article 5 Bills reviewed by the committees of Legislative Yuan shall be distributed by the PC according to the following rules and reported to the session for resolutions.
(1) Internal Administration Committees: To review policies relating to home affairs, elections, Mongolian and Tibetan affairs, mainland affairs, indigenous peoples, Hakka affairs and coast guard administration; and bills related to the functions and duties of the Ministry of the Interior, Central Election Commission, Mongolian and Tibetan Affairs Commission, Mainland Affairs Council, Council of Indigenous Peoples, Council for Hakka Affairs and Coast Guard Administration.
(2) Foreign and National Defense Committee: To review policies relating to foreign affairs, overseas compatriot affairs, national defense and veterans guidance and motions concerning war declaration, peace-making, treaties and martial law; and bills falling within the functions and duties of the Ministry of Foreign Affairs, Overseas Compatriot Affairs Commission, Ministry of National Defense and Veterans Affairs Commission.
(3) Economics Committee: To review policies relating to economic affairs, agricultural affairs, economic planning and development, fair trade, energy and technology development; and bills falling within the functions and duties of the Ministry of Economic Affairs, Council of Agriculture, Council for Economic Planning and Development and Fair Trade Commission.
(4) Finance Committee: To review financial and banking policies, budget, final accounting, statistics and audits; and the bills falling within the functions and duties of the Ministry of Finance, Central Bank, Financial Supervisor Commission, and Directorate-General of Budget, Accounting and Statistics.
(5) Education and Culture Committee: To review educational and cultural policies and bills falling within the functions and duties of the Ministry of Education, Council for Cultural Affairs, National Palace Museum, Government Information Office, National Youth Commission, Sports Affairs Council, Academia Sinica, National Science Commission and Atomic Energy Commission.
(6) Transportation Commission: To review transportation, public construction and communications policies; and bills falling within the functions and duties of the Ministry of Transportation and Communication, Public Project Commission and National Communications Commission.
(7) Judiciary and Organic Laws and Statutes Committee: To review civil affairs, criminal affairs, administrative litigations, disciplinary actions, amnesty, agency organization, and research, development and evaluation; affairs falling within the functions and duties of the Ministry of Justice; Research, Development and Evaluation Commission; and Central Personnel Administration; and bills not covered in the functions and duties of any committees. Bills of state businesses shall be reviewed by the relevant committee according to their nature.
(8) Social Welfare and Environmental Hygiene Committee: To review policies relating to public health, environment, social welfare, labor affairs and consumer protection; and bills falling within the functions and duties of the Department of Health, Environmental Protection Administration, Department of Social Affairs and Child Welfare Bureau (MOI), Council of Labor Affairs and Consumer Protection Commission.
Bills related to other committees shall be reviewed by the reviewing committee and the relevant committees.
Article 6 The PC shall hold routine meetings twice a week and provisional meetings where necessary.
Article 7 The Conference Department Director shall attend the PC meeting, including the Secretary General and Deputy Secretary General where necessary.
Article 8 The PC is equipped with one secretary, one editor, one executive officer, 3 officers and 2 clerks appointed by the Conference Department.
Article 9 These Rules shall be implemented after being approved by the Legislative Yuan
Articles passed by the session on 30 November 2007 shall be implemented since the inauguration of the 7th legislature.
